  Dark Fiber Licensing Fees  

          

        Chapter 14.48 DARK FIBER LICENSING FEES

14.48.010 Backbone annual licensing fees.


This fee applies for the use of fibers on the fiber optic backbone that was constructed
by the utility, and is stated in units of dollars per fiber per route-mile per year
($/FMY). See Chart A below for fiber base price determined on length of licensing
term and fiber quantity. Dark fibers are the optical fibers that are owned by the utility
that are currently in place but are not being used and have been allocated to license to
others. Dark fibers do not include any terminal equipment required for the fibers
operation.

14.48.020 Discounts


Once the base price is determined from Chart A (Section 14.48.010), additional price
discounts may apply per fiber. A Ring Topology Discount. Two hundred dollars/ FMY.
Available for fibers licensed in a complete ring around the city's backbone system.


A. Buffer Tube Discount. Fifty dollars/FMY. Available for fibers

    simultaneously requested in groups of twelve (i.e., complete buffer tubes)
    along the fiber backbone system.
B. Other Services. Additional discounts may be available for licensees that
    provide other services or incentives to Longmont Power & Communications.
    Services may include, but are not limited to, restoration support, bandwidth
    lease rate discounts, and aid in construction of additional network.
C. Public Benefit Discount. Subject to city council approval, an additional
    discount may be available for licensees that use the city's fiber to provide a
    substantial public benefit in Longmont. These public benefits may include,
    but are not limited to, multiple type of services and connections to
    commercial and residential customers. (Ord. 0-98-63 § 1 (part))

14.48.030 One-time set-up fees


A. Configuration Fee. Three hundred dollars per splice location for access to
    licensed fibers. Fee covers only documentation costs, no installation or
    materials.
B. Inspection Fee. One hundred twenty dollars per splice location. Fee to
    cover cost of city's personnel for site inspection and approval of the
    interconnection to licensed fibers.
C. Other Fees. Time and materials plus ten percent. Fee for city to install
    the connections to the licensed fibers, if provided by the city. (Ord.

14.48.040 Annual fiber usage charges


Annual fees for the use of the city's fibers must be paid in advance for each
calendar year. The prices stated are in 1998 dollars. They will be prorated to
reflect partial years and will escalate with the Denver/Boulder Consumer Price
Index as described in the license agreement. (Ord. 0-98-63 § 1 (part))
